Action Alert: Contact South Carolina Senators

South Carolina’s H.3775 is headed for a Senate and possible House vote. Contact senators to ask them to vote no. Information and suggested messages are below. Subject: H3775: Please Vote No

Dear Honorable Senator:

House Bill 3775 may come before you for vote today. Although I appreciate Representative Patsy Knight’s efforts and willingness to introduce a bill that at first provided adult adoptees’ with rights to obtain their own original birth certificates, I cannot support the current amended version of H3775. I ask you to vote No on the bill.

The bill creates a complicated and ultimately expensive tiered system of access where adoptees are treated differently according to the date of an adoption. States that have tried this approach have quickly realized that it only creates an expensive and bureaucratic system that preserves and promotes inequality.

Please view all South Carolina born citizens as equal and deserving of the same legal considerations and constitutional rights as all other persons. Please vote No on H.3775.

What’s an Original Birth Certificate?

Most adopted persons know what an original birth certificate (OBC) is. Many non-adopted people do not. An original birth certificate is the initial birth certificate created shortly after a person's birth. For most people, it is their only birth certificate.

For persons born and adopted in the United States, a new or "amended" birth certificate replaces the OBC once the adoption is final. In addition to replacing the original, the names of the birth parents are also replaced with the names of the adoptive parents. Some states may also alter or omit additional information on a new certificate, including the adoptee's specific place of birth.

Depending on state law, an original birth certificate is sealed and remains unavailable to the adopted person, even when they become an adult. If you are not adopted, your original birth certificate is your only birth certificate---and it is always available to you upon request.
